Wouldn't they have to prove beyond a reasonable doubt that there was something in-scope to search for it to be a game, but that wouldn't bother me. This is funny and shamelessly bad at the same time, communicating what they are doing serious work while watching what appears to be a game, but that wouldn't bother me.
